Terms of Use.
1. Agreement
These Terms of Use ("Terms") govern your use of the Flashlight mobile application (the "App") published by Codeensis Ltd. ("we", "our", "us"), Arch. Makariou III 155, 3026 Limassol, Cyprus. By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use, subject to these Terms and the Google Play terms of service.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the App, except where such activity is expressly permitted by applicable law.
- Use the App in a manner that could damage, disable, overburden, or impair the App or any device.
- Use the App or its SOS feature to falsely signal an emergency or to harass any person.
- Use the App in any way that violates applicable law, including export control, anti-discrimination, or anti-harassment laws.
4. Emergency disclaimer
The SOS feature transmits a visible Morse-code signal using your device's LED flash and screen. It does not contact emergency services, transmit your location, or notify any third party. In an emergency, always contact your local emergency services first (e.g. 112 in the EU, 911 in North America).
5. Battery and device safety
Sustained use of the LED flash, the strobe mode, or the screen-light mode at full brightness can warm the device and consume battery quickly. The strobe and SOS modes produce rapidly flashing light that may be uncomfortable for some users and may trigger seizures in people with photosensitive epilepsy. Discontinue use if you feel unwell.
6. No warranty
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, compatible with every device, or that defects will be corrected.
7. Limitation of liability
To the maximum extent permitted by law, Codeensis Ltd. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses arising out of or relating to your use of, or inability to use, the App. Our total aggregate liability arising from these Terms shall not exceed the greater of (a) the amount you paid for the App (which is zero) or (b) ten euros (€10).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for gross negligence or fraud).
8. Updates and availability
We may release updates to the App at any time. Updates may add, modify, or remove features. We may, in our discretion, discontinue support for older device or operating-system versions. We may suspend or discontinue the App at any time without notice.
9. Privacy
Your use of the App is also governed by the Flashlight Privacy Policy, which forms part of these Terms by reference.
10. Intellectual property
The App, including its source code, design, branding, icons, and copy, is owned by Codeensis Ltd. and protected by intellectual-property laws. These Terms grant you only the rights expressly stated; all other rights are reserved.
11. Third-party services
The App is distributed through Google Play, operated by Google LLC. Your installation, updates, billing (where applicable), and refunds are governed by the Google Play terms. We are not responsible for the operation of the Play Store itself.
12. Termination
You may stop using the App and uninstall it at any time. We may terminate or suspend your license under these Terms with immediate effect if you breach them. Provisions that by their nature should survive termination (such as warranty disclaimers, limitation of liability, and governing law) shall survive.
13. Governing law and venue
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus, except that consumers resident in the EU retain the protections of mandatory consumer-protection laws of their country of residence.
14. Changes to these Terms
We may update these Terms as the App evolves. Material changes will be reflected here with an updated "Effective" date above. Continued use of the App after a change constitutes acceptance of the updated Terms.
