Terms of Use.
1. Agreement
These Terms of Use ("Terms") govern your use of the SunPlanner application ("SunPlanner", "the app"), provided by CodeEnsis Ltd. ("we", "our", "us"), Χριστόδουλου Σώζου 2, EIFFEL TOWER, Floor 3, Flat/Office 301, 1096 Λευκωσία, Κύπρος. By installing, accessing or using SunPlanner you agree to these Terms. If you do not agree, do not use the app.
2. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use SunPlanner on devices you own or control, subject to these Terms and to the rules of the app store from which you obtained it. All rights not expressly granted are reserved by CodeEnsis Ltd.
3. SunPlanner Pro
SunPlanner Pro is a single one-time purchase. It is not a subscription: it is charged once, never renews, and there is nothing to cancel. It unlocks any date and time, the summer and winter solstice arcs, the moon (path, phase, rise and set), saved places and sun hours at a spot. The price, currency and any taxes are shown on the purchase screen before you confirm, in your local currency as set by Google Play.
The purchase is processed by Google Play (or by Apple, if an iOS version is released); we never see or handle your payment details. To restore Pro on another device, use the same store account and tap Restore purchases on the purchase screen or in Settings. Refunds are handled by the store under its refund policies. If you are a consumer in the EU or UK, your statutory withdrawal and refund rights are unaffected by these Terms. We may change the price of Pro; a change never affects a purchase you have already made.
4. What the numbers are
Sun and moon positions are computed on your phone from published astronomical formulas (the NOAA solar equations and a low-precision lunar theory). Directions shown in the compass and AR views depend on your phone's sensors, which are typically accurate to a few degrees and can be disturbed by metal, magnets or poor calibration. Sun hours at a spot are an estimate based on the skyline you mark by hand and do not account for weather or clouds.
SunPlanner is a planning aid. It is not a survey, an engineering tool, a solar-yield calculation or professional advice. Do not rely on it alone for decisions where an error could cause injury or financial loss.
5. Safety
Never look directly at the sun, with or without the camera, and never point optical instruments at it. Pay attention to your surroundings, traffic and terrain while using the camera view.
6. Your data
Your saved places, notes and settings are stored only on your device (see our Privacy Policy). You are responsible for keeping your own copies. We are not liable for data lost due to device failure, reset or app removal.
7. Updates and availability
We may release updates, fixes and new features, and may change or discontinue features or the app itself at our discretion.
8. Intellectual property
SunPlanner, including its source code, design, name and logo, is the property of CodeEnsis Ltd. and is protected by copyright and other intellectual property laws. The app uses third-party open-source components and fonts subject to their respective licences.
9. No warranty
SunPlanner is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy or non-infringement, to the maximum extent permitted by law.
If you are a consumer, you may have statutory rights that cannot be excluded by contract, for example the rights that apply in the EU and the UK when digital content does not conform to the contract. Nothing in these Terms limits those rights.
10. Limitation of liability
To the maximum extent permitted by applicable law, CodeEnsis Ltd., its officers, employees or affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or profits, arising out of or related to your use of (or inability to use) the app.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or related to the app shall not exceed the greater of (a) the amount you paid for the app and for SunPlanner Pro in the 12 months preceding the claim, or (b) ten euro (€10). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, and your rights under mandatory consumer protection law.
11. Privacy
Your use of SunPlanner is also governed by our Privacy Policy.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Nicosia, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
13. App store terms
If you obtained SunPlanner through Google Play or the App Store, you also agree to that store's terms. To the extent of any conflict, the store's terms govern platform-specific obligations such as refunds and in-app purchases. The store operator is not a party to these Terms and has no responsibility for the app.
14. Changes to these Terms
We may update these Terms. The effective date above shows the current version. Continued use of the app after a change means you accept the updated Terms.
