Terms of Use.
1. Agreement
These Terms of Use ("Terms") govern your use of the StageMeter mobile application ("StageMeter", "the app"), provided by CodeEnsis Ltd. ("we", "our", "us"), Χριστόδουλου Σώζου 2, EIFFEL TOWER, Floor 3, Flat/Office 301, 1096 Λευκωσία, Κύπρος. By installing, accessing, or using StageMeter you agree to be bound by these Terms. If you do not agree, do not use the app.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use StageMeter on devices you own or control, for your own personal use, subject to these Terms and to the rules of the app store from which you obtained it. All rights not expressly granted are reserved by CodeEnsis Ltd.
3. Not official timing, and not a driving aid
StageMeter is a consumer measurement tool. Its distance, speed, elapsed-time, and pace-deviation readings are derived from your phone's GPS and are informational only. They are not an official or certified timing system and must not be relied upon to resolve a scoring dispute, penalty, or classification in any competitive or regularity event — always defer to the event's official timing and officials. StageMeter is also not a driving aid: mounting or interacting with a phone while driving may be restricted or illegal where you drive, and using the app is never a substitute for keeping your attention on the road, course, or co-driver duties. You use StageMeter, and any vehicle you operate while it runs, at your own risk and in accordance with applicable law.
4. Accuracy and device sensors
Reading accuracy depends on your device's GPS signal, satellite geometry, and your surroundings (tunnels, dense tree cover, tall buildings, and similar conditions can degrade or interrupt a GPS fix). StageMeter does not guarantee that any reading is correct, current, or fit for a particular purpose.
5. Your data
Session data (distance, speed, elapsed time) lives in the app while a session is running and is not saved as persistent trip history (see our Privacy Policy). You are responsible for noting or recording any figures you need to keep. We are not liable for data lost due to an app restart, device failure, loss, or app removal.
6. Price and purchases
StageMeter's trip meter is free. Time Control, Special Stage, and TSD/Regularity unlock with a single one-time purchase processed by the App Store or Google Play — no subscription, no recurring charge. Refunds are handled by Apple or Google under their respective policies; we do not process payments or refunds directly.
7. Acceptable use
You agree not to reverse-engineer, decompile, resell, or misuse the app, remove proprietary notices, or use StageMeter in violation of applicable law.
8. Updates and availability
We may release updates, fixes, and new features, and may discontinue features or the app itself at our discretion. Uptime, continued availability, and backward compatibility of any specific feature are not guaranteed.
9. Intellectual property
StageMeter, including its source code, design, name, and logo, is the property of CodeEnsis Ltd. and is protected by copyright and other intellectual property laws. The app uses third-party open-source and platform components subject to their respective licenses.
10. No warranty
StageMeter is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement, to the maximum extent permitted by law. We make no warranty that any distance, speed, timing, or pace reading is correct, current, or fit for any particular purpose.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall CodeEnsis Ltd., its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss, injury, penalty, disqualification, or decision made in reliance on StageMeter's output, arising out of or related to your use of (or inability to use) the app.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim shall not exceed the amount you paid for StageMeter's one-time purchase, or ten euro (€10) if you made no purchase. Nothing in these Terms excludes liability that cannot lawfully be excluded, including under EU consumer protection law.
12. Indemnification
You agree to defend, indemnify, and hold harmless CodeEnsis Ltd. and its affiliates from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of your use of StageMeter, your violation of these Terms, or your violation of any third party's rights or applicable law.
13. Privacy
Your use of StageMeter is also governed by our Privacy Policy.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Nicosia, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
15. App store terms
If you obtained StageMeter through the App Store or Google Play, you also agree to Apple's or Google's respective terms. To the extent of any conflict between these Terms and platform terms, platform terms govern with respect to platform-specific obligations.
16. Changes to these Terms
We may update these Terms as StageMeter evolves. Material changes will be reflected here with an updated "Effective" date above. Continuing to use StageMeter after a change means you accept the updated Terms.
