HEEL DROP
Terms of Service.
1. Agreement
These Terms of Service ("Terms") govern your use of the Heel Drop mobile application ("Heel Drop", "the app"), provided by CodeEnsis Ltd. ("we", "our", "us"), Χριστόδουλου Σώζου 2, EIFFEL TOWER, Floor 3, Flat/Office 301, 1096 Λευκωσία, Κύπρος. By installing, accessing, or using Heel Drop you agree to be bound by these Terms. If you do not agree, do not use the app.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Heel Drop on devices you own or control, for your own personal or professional use, subject to these Terms and to the rules of the app store from which you obtained it. All rights not expressly granted are reserved by CodeEnsis Ltd.
3. Raw measured data, not a certified engineering tool
Heel Drop measures acceleration using your phone's built-in, consumer-grade MEMS accelerometer and computes FFT and PSD spectra, peak frequency, RMS acceleration, and (Pro) velocity/displacement from that raw signal. These are measurement tools, not professional engineering advice, and not a certified compliance assessment under any building code or standard.
Where Heel Drop shows a comparison against a published vibration-serviceability guideline (for example, AISC Design Guide 11), that comparison is a simplified reference threshold for engineering judgment only - it is not a certified calculation performed under that guideline, and it does not constitute a pass/fail determination. You, or the licensed engineer reviewing the report, are solely responsible for interpreting the measured data and for any decision made in reliance on it.
4. Accuracy and measurement conditions
Consumer phone accelerometers have a noise floor and mounting characteristics that differ from purpose-built vibration-measurement instruments. Results depend on the phone being reasonably level and firmly coupled to the measured surface, as reflected by the app's own level-check step. We make no representation that any measurement matches what a calibrated, purpose-built instrument would report.
5. Your data and backups
Your session data is stored locally on your device (see our Privacy Policy). You are responsible for maintaining your own backups, including exporting CSV/PDF copies of sessions you need to keep. We are not liable for data lost due to device failure, loss, deletion, or app removal.
6. Heel Drop Pro and payments
Live time-domain, FFT, peak-frequency detection, and PDF reports are free. Pro features - PSD analysis, velocity/displacement integration, raw CSV export, and unlimited saved sessions - require a Heel Drop Pro subscription, purchased and billed through the App Store or Google Play. Pricing, currency, and applicable taxes are shown at the point of purchase. Pro renews according to the terms shown at purchase and can be managed or cancelled in your Apple ID or Google Play account. Refunds are handled under the policies of the app store through which you purchased.
7. Acceptable use
You agree not to reverse-engineer, decompile, resell, or misuse the app, remove proprietary notices, misrepresent Heel Drop's output as a certified engineering assessment, or use Heel Drop in violation of applicable law.
8. Updates and availability
We may release updates, fixes, and new features, and may discontinue features or the app itself at our discretion. Uptime, continued availability, and backward compatibility of any specific feature are not guaranteed.
9. Intellectual property
Heel Drop, including its source code, design, name, and logo, is the property of CodeEnsis Ltd. and is protected by copyright and other intellectual property laws. The app uses third-party open-source components subject to their respective licenses.
10. No warranty
Heel Drop is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement, to the maximum extent permitted by law. We make no warranty that measured values, spectra, or guideline comparisons are correct, current, or fit for any particular structural, safety, or compliance purpose.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall CodeEnsis Ltd., its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss, injury, or professional/engineering decision made in reliance on Heel Drop's output, arising out of or related to your use of (or inability to use) the app.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid CodeEnsis for the app in the 12 months preceding the claim, or (b) ten euro (€10). Nothing in these Terms excludes liability that cannot lawfully be excluded, including under EU consumer protection law.
12. Indemnification
You agree to defend, indemnify, and hold harmless CodeEnsis Ltd. and its affiliates from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of your use of Heel Drop, your violation of these Terms, or your violation of any third party's rights or applicable law.
13. Privacy
Your use of Heel Drop is also governed by our Privacy Policy.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Nicosia, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
15. App store terms
If you obtained Heel Drop through the App Store or Google Play, you also agree to Apple's or Google's terms. To the extent of any conflict between these Terms and platform terms, platform terms govern with respect to platform-specific obligations (for example, refunds and in-app purchases).
16. Changes to these Terms
We may update these Terms as Heel Drop evolves. Material changes will be reflected here with an updated "Effective" date above. Continuing to use Heel Drop after a change means you accept the updated Terms.
