BAROMETER
Terms of Service.
1. Agreement
These Terms of Service ("Terms") govern your use of the Barometer mobile application ("Barometer", "the app"), provided by CodeEnsis Ltd. ("we", "our", "us"), Χριστόδουλου Σώζου 2, EIFFEL TOWER, Floor 3, Flat/Office 301, 1096 Λευκωσία, Κύπρος. By installing, accessing, or using Barometer you agree to be bound by these Terms. If you do not agree, do not use the app.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Barometer on devices you own or control, for your own personal use, subject to these Terms and to the rules of the app store from which you obtained it. All rights not expressly granted are reserved by CodeEnsis Ltd.
3. Not a weather service
The forecast Barometer shows is produced by the Zambretti forecaster, a mechanical method published in the 1910s that maps the current sea-level pressure, the direction it is moving, the season, and the reported wind onto one of twenty-six standard phrases. It uses no weather model, no satellite data, and no meteorological service. It is right often enough to be genuinely useful and wrong often enough that it must not be treated as a forecast from a national weather agency. For weather warnings, always consult your official meteorological service.
4. Not for navigation or safety-critical use
Barometer is a consumer measurement tool. Its readings - pressure, its rate of change, and anything derived from them - come from your phone's sensors and from a public weather-station feed, and are informational only. They are not certified and must not be relied upon for aviation, marine, or mountaineering safety, for altimeter setting, for surveying, search-and-rescue, or any situation where an error could cause injury, loss, or damage. You use Barometer's output at your own risk.
5. Accuracy and device sensors
Reading accuracy depends on whether your device has a barometric pressure sensor, on that sensor's calibration, and on the altitude used to reduce the reading to sea level. On a device without a sensor, the reading comes from the nearest reporting weather station, which may be up to 150 km away and up to an hour old. Barometer does not guarantee that any reading is correct, current, or fit for a particular purpose.
6. Storm alerts
The storm alert is a convenience, not a warning system. It fires when the app's own log shows the pressure falling rapidly, which means it can only fire while the app has been running and collecting readings, and it will miss weather it did not see. It is not a substitute for official severe-weather warnings, and no alert - or a missing alert - should be read as a statement about your safety.
7. Your data and backups
Your data is stored locally on your device (see our Privacy Policy). You are responsible for maintaining your own backups. We are not liable for data lost due to device failure, loss, deletion, or app removal.
8. Price
Barometer is free to download and use. It contains no purchases and no advertising. Optional crash diagnostics and analytics are off by default and require your consent, as described in the Privacy Policy.
9. Acceptable use
You agree not to reverse-engineer, decompile, resell, or misuse the app, remove proprietary notices, or use Barometer in violation of applicable law.
10. Updates and availability
We may release updates, fixes, and new features, and may discontinue features or the app itself at our discretion. Uptime, continued availability, and backward compatibility of any specific feature are not guaranteed.
11. Intellectual property
Barometer, including its source code, design, name, and logo, is the property of CodeEnsis Ltd. and is protected by copyright and other intellectual property laws. The app uses third-party open-source components subject to their respective licenses, and reads observations from the Aviation Weather Center, a United States government public-domain data product.
12. No warranty
Barometer is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement, to the maximum extent permitted by law. We make no warranty that any pressure reading or forecast phrase is correct, current, or fit for any particular purpose.
13. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall CodeEnsis Ltd., its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss, injury, or decision made in reliance on Barometer's output, arising out of or related to your use of (or inability to use) the app.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim shall not exceed ten euro (€10). Nothing in these Terms excludes liability that cannot lawfully be excluded, including under EU consumer protection law.
14. Indemnification
You agree to defend, indemnify, and hold harmless CodeEnsis Ltd. and its affiliates from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of your use of Barometer, your violation of these Terms, or your violation of any third party's rights or applicable law.
15. Privacy
Your use of Barometer is also governed by our Privacy Policy.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Nicosia, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
17. App store terms
If you obtained Barometer through Google Play, you also agree to Google's terms. To the extent of any conflict between these Terms and platform terms, platform terms govern with respect to platform-specific obligations.
