TONUMA
Terms of Use.
1. Agreement
These Terms of Use ("Terms") govern your use of the Tonuma application ("Tonuma", "the app"), provided by CodeEnsis Ltd. ("we", "our", "us"), Χριστόδουλου Σώζου 2, EIFFEL TOWER, Floor 3, Flat/Office 301, 1096 Λευκωσία, Κύπρος. By installing, accessing or using Tonuma you agree to these Terms. If you do not agree, do not use the app.
2. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Tonuma on devices you own or control, subject to these Terms and to the rules of the app store from which you obtained it. All rights not expressly granted are reserved by CodeEnsis Ltd. Tonuma is not intended for children under 13.
3. Free use and Tonuma Premium
The free version includes four presets and white, pink and brown noise, with no time limit. Tonuma Premium unlocks all presets, the mixer, saved mixes and longer timers.
Premium is offered as an auto-renewing yearly subscription with a free trial, an auto-renewing monthly subscription, and a one-time lifetime purchase. The price, currency, trial length and any taxes are shown on the purchase screen before you confirm, in your local currency as set by the store.
- Payment is charged to your Google Play or Apple ID account at confirmation of purchase, or at the end of the free trial.
- A subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
- If you start a free trial, the app sends a reminder notification about 24 hours before it ends, if notifications are allowed. The reminder is a courtesy, not a guarantee.
- Manage or cancel a subscription in Google Play → Payments & subscriptions, or in your Apple ID settings → Subscriptions. Deleting the app does not cancel it.
The purchase is processed by the store and managed through RevenueCat; we never see or handle your payment details. To restore Premium on another device, use the same store account and tap Restore purchases in the app. Refunds are handled by the store under its refund policies. If you are a consumer in the EU or UK, your statutory withdrawal and refund rights are unaffected by these Terms. We may change the price of a plan; a change applies to renewals only after the store has notified you where required.
4. Not a medical device
Tonuma is intended to help you settle into focus, rest or sleep. It is not a medical device, gives no medical advice and does not diagnose, treat, cure or prevent any condition. Descriptions of beat frequencies (delta, theta, alpha, beta, gamma) describe the sound, not a promised effect on your body or mind. Results differ from person to person.
5. Listening safely
- Do not listen while driving, operating machinery or doing anything that needs your full attention.
- Keep the volume low, especially with headphones and when falling asleep. Long listening at high volume can damage hearing.
- If you have epilepsy or a history of seizures, a heart condition, a hearing condition, or are pregnant, ask your doctor before use. Stop if you feel discomfort, dizziness or anxiety.
6. Playback and timers
Background playback, timers and reminders depend on your phone's operating system, battery optimisation and permissions, and may be stopped or delayed by the system. Listening time, progress and streaks are approximate.
7. Your data
Your sessions, mixes and settings are stored only on your device (see our Privacy Policy). We are not liable for data lost due to device failure, reset or app removal.
8. Updates and availability
We may release updates, fixes and new features, and may change or discontinue features or the app itself at our discretion. A lifetime purchase covers Premium features for as long as we offer the app in the store.
9. Intellectual property
Tonuma, including its source code, sound design, images, name and logo, is the property of CodeEnsis Ltd. and is protected by copyright and other intellectual property laws. The app uses third-party open-source components subject to their respective licences.
10. No warranty
Tonuma is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy or non-infringement, to the maximum extent permitted by law.
If you are a consumer, you may have statutory rights that cannot be excluded by contract, for example the rights that apply in the EU and the UK when digital content does not conform to the contract. Nothing in these Terms limits those rights.
11. Limitation of liability
To the maximum extent permitted by applicable law, CodeEnsis Ltd., its officers, employees or affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or profits, arising out of or related to your use of (or inability to use) the app.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or related to the app shall not exceed the greater of (a) the amount you paid for Tonuma Premium in the 12 months preceding the claim, or (b) ten euro (€10). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, and your rights under mandatory consumer protection law.
12. Privacy
Your use of Tonuma is also governed by our Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Nicosia, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
