Terms of Use.
1. Who provides Tomelight
Tomelight is published by CodeEnsis Ltd. ("we", "our", "us"), a company registered in Cyprus. These terms govern your use of the app. Questions: [email protected].
2. Use of the app
You may use Tomelight for its intended personal purpose — reading books you own or are otherwise entitled to read, listening to them, and looking words up. You may not use the app in a way that violates law, infringes a third-party right, attempts to reverse-engineer, decompile or otherwise extract source code beyond what local law expressly permits, or interferes with the app's normal operation.
3. Your books are yours, and your responsibility
Tomelight ships with no books and sells none. Every file you open, and every folder you connect, is one you chose. You are responsible for having the right to read, copy and store the files you add, and for complying with the licence of each book and with copyright law in your country. We do not review, host, index or distribute the content you open.
4. Folders you connect
When you point Tomelight at a folder — on the device or through a cloud provider — you grant it read access through Android's own file picker, and you can revoke that access at any time. Tomelight only reads the folder and copies EPUB and FB2 files out of it; it never modifies the folder. We are not responsible for the availability of a third-party cloud provider, for changes to its apps, or for files that disappear, change or fail to download on its side.
5. Your data, and the absence of backup
Your library, reading positions, bookmarks and settings live on your device only (see Privacy Policy). There is no account and no cloud sync, which means we cannot recover anything if you delete the app, clear its data, reset the device or lose it. If a reading position or a collection matters to you, keep the source files somewhere else as well.
6. Dictionaries and reading aloud
Offline dictionaries are compiled from openly licensed sources — principally Wiktionary, under the Creative Commons Attribution-ShareAlike licence — and are provided for convenience, without any warranty of accuracy or completeness of a translation or definition. Attribution and licence for each dictionary are shown in Settings → Licences and sources.
Sentence translation, a Tomelight Pro feature, is machine translation performed on your device by Google ML Kit. It is provided to help you understand a passage and may be inaccurate or incomplete; do not rely on it where accuracy matters.
Read-aloud is performed by the speech engine installed on your device, not by us. Its quality, its voices, its availability offline and its own privacy terms are determined by that engine and its publisher.
7. Tomelight Pro and payments
Reading, dictionaries, read-aloud, saved words, highlights and notes are free and contain no advertising. Some additional features (sentence translation, review cards and export) are offered as Tomelight Pro, in two forms:
- Yearly subscription. Gives access to Pro for one year and renews automatically for another year at the then-current price, unless you cancel it.
- Lifetime purchase. A one-time payment with no renewal. It gives access to Pro for as long as Tomelight is offered, on the store account that made the purchase.
The price, in your local currency, is shown in the app before you confirm a purchase. Payment is taken by Google Play or the App Store from the account you use there. Their terms govern payment, taxes and refunds, and they, not we, hold your payment details.
Automatic renewal. The subscription is charged to your store account within 24 hours before the end of the current period. To stop the next charge, cancel at least 24 hours before the period ends: on Android in Google Play → Profile → Payments and subscriptions → Subscriptions; on iPhone in Settings → your name → Subscriptions. After cancelling you keep Pro until the end of the period you already paid for. Deleting the app does not cancel a subscription.
Refunds. Refunds are handled by Google Play or Apple under their refund policies; we cannot issue them directly. If something went wrong with a purchase, write to us and we will help you with the request.
Restoring a purchase. A purchase belongs to your store account, not to a Tomelight account. On a new device, or after reinstalling, sign in to the same store account and tap “Restore purchases” on the Tomelight Pro screen.
Price changes. If the subscription price changes, the store will notify you in advance according to its rules, and you can cancel before the new price applies.
8. Availability and changes
The app is provided on an "as is" and "as available" basis. Features, supported formats, integrations and availability may change without prior notice. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Liability
To the maximum extent permitted by law, in no event will CodeEnsis Ltd., its directors, employees, contractors or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or goodwill, arising from or related to your use of, or inability to use, Tomelight — including a lost reading position, a book that fails to open or render as its publisher intended, or a file damaged or lost on a connected folder. Where this limitation cannot be applied under your local law, our aggregate liability will not exceed the greater of the amount you paid us in the twelve months before the claim or ten US dollars.
10. Governing law
These terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence remain unaffected.
11. Changes to these terms
We may update these terms as Tomelight evolves. Material changes will be reflected here with an updated "Effective" date above. Continued use of the app after a change means you accept the updated terms. If you don't accept them, stop using the app and uninstall it.
