Terms of Use.
1. Agreement
These Terms of Use ("Terms") govern your use of the Stairgauge mobile application ("Stairgauge", "the app"), provided by CodeEnsis Ltd. ("we", "our", "us"), Χριστόδουλου Σώζου 2, EIFFEL TOWER, Floor 3, Flat/Office 301, 1096 Λευκωσία, Κύπρος. By installing, accessing or using Stairgauge you agree to be bound by these Terms. If you do not agree, do not use the app.
2. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Stairgauge on devices you own or control, for your own personal or internal business use, subject to these Terms and to the rules of the app store from which you obtained it. All rights not expressly granted are reserved by CodeEnsis Ltd.
3. Layout aids, not a permit or a structural design
Stairgauge calculates riser and tread dimensions, run, angle, stringer length, throat, framing-square settings, stock lengths and material quantities from the figures you enter and from built-in typical values. Its results are layout aids. They are not a building permit, not an inspection, not a structural or engineering design, and not professional or legal advice.
- Results are only as good as the measurements you enter. Measure floor to floor on site, include floor finishes still to be installed, and check the first and last riser before cutting.
- The building-code checks compare your stair with reference limits for private (one- and two-family) dwellings from the codes the app names (for example IRC R311.7, Approved Document K, NBC 9.8, NCC, DIN 18065). Codes are adopted, amended and interpreted locally and change between editions. A passed check means the stair met the limits Stairgauge checks for the values entered - nothing more. Your local building authority has the final say.
- Stringer spacing, throat and lumber suggestions are rules of thumb. Spans, loads, fastening, guards, handrails, footings and connections are not checked and must follow the applicable code and, where required, an engineer's design.
You are solely responsible for what you build, how you build it and the materials you buy. Check the results before you cut.
4. Your data and backups
Your data is stored locally on your device (see our Privacy Policy). You are responsible for maintaining your own backups. We are not liable for data lost due to device failure, loss, deletion or app removal.
5. Stairgauge Pro - what you are buying
Calculating stairs, the stringer layout, all precision settings and all building-code checks are free and always will be. Pro removes the limit on saved jobs and unlocks the cut-sheet PDF. Pro is offered in two forms:
- Yearly - an auto-renewing subscription billed every twelve months.
- Lifetime - a single one-time purchase. It does not renew and is not a subscription.
The exact price, currency, billing period and any applicable taxes are shown on the purchase screen inside the app before you confirm, in your local currency as set by the app store. Purchases are processed by Apple's App Store or by Google Play; we never see or handle your payment details.
6. Renewal, cancellation and refunds
For the yearly subscription:
- The subscription renews automatically at the end of each billing period unless you cancel it.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price then shown for your plan.
- You may cancel at any time, but you must do so at least 24 hours before the current period ends to avoid being charged for the next one. Cancelling takes effect at the end of the period already paid for; you keep Pro until then.
- Manage or cancel in Settings › [your name] › Subscriptions on iOS, or in Google Play › Payments & subscriptions › Subscriptions on Android. Deleting the app does not cancel a subscription.
- Any unused portion of a free trial, where one is offered, is forfeited when you purchase a subscription.
The lifetime purchase is charged once and never renews, so there is nothing to cancel. Restoring purchases on a new device is done with "Restore purchases" in the app, using the same Apple or Google account.
Refunds are handled by the store you bought through, under Apple's or Google's refund policies, not by us. If you are a consumer in the EU or UK, your statutory withdrawal and refund rights are unaffected by these Terms.
7. Price changes
We may change the price of Pro. A change never affects a lifetime purchase you have already made. For subscriptions, a price increase applies only from a future renewal, and the app store will notify you and, where required, ask for your consent before it takes effect. If you do not accept, cancel before the renewal date.
8. Acceptable use
You agree not to reverse-engineer, decompile, resell or misuse the app, remove proprietary notices, or use Stairgauge in violation of applicable law.
9. Updates and availability
We may release updates, fixes and new features, and may discontinue features or the app itself at our discretion. Calculation rules and code limits may change with an update, so a saved stair can give a different result after one; the cut sheet names the calculation version that produced it.
10. Intellectual property
Stairgauge, including its source code, design, name and logo, is the property of CodeEnsis Ltd. and is protected by copyright and other intellectual property laws. Building codes are cited for reference and remain the property of their publishers. The app uses third-party open-source components subject to their respective licences.
11. No warranty
Stairgauge is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness or non-infringement, to the maximum extent permitted by law. We make no warranty that calculated dimensions, code checks, cut lists or material quantities are correct, current, complete or sufficient for any particular stair.
12. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall CodeEnsis Ltd., its officers, employees or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, materials bought or wasted, rework, failed inspections, damage to property, or decisions made in reliance on Stairgauge's output, arising out of or related to your use of (or inability to use) the app.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid CodeEnsis for the app in the 12 months preceding the claim, or (b) ten euro (€10). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, and under EU consumer protection law.
13. Indemnification
You agree to defend, indemnify and hold harmless CodeEnsis Ltd. and its affiliates from any claim, loss, liability, damage or expense (including reasonable legal fees) arising out of your use of Stairgauge, your violation of these Terms, or your violation of any third party's rights or applicable law.
14. Privacy
Your use of Stairgauge is also governed by our Privacy Policy.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Nicosia, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
16. App store terms
If you obtained Stairgauge through the App Store or Google Play, you also agree to Apple's or Google's terms respectively, including Apple's Standard End User License Agreement where it applies. To the extent of any conflict between these Terms and platform terms, platform terms govern with respect to platform-specific obligations (for example, refunds and in-app purchases). Apple and Google are not parties to these Terms and have no responsibility for the app, but each may enforce these Terms against you as a third-party beneficiary.
17. Changes to these Terms
We may update these Terms as Stairgauge evolves. Material changes will be reflected here with an updated "Effective" date above. Continuing to use Stairgauge after a change means you accept the updated Terms.
