Terms of Service.
1. Agreement
These Terms of Service ("Terms") govern your use of the Pawpress mobile application ("Pawpress", "the app"), provided by Codeensis Ltd. ("we", "our", "us"), Arch. Makariou III 155, 3026 Limassol, Cyprus. By installing, accessing, or using Pawpress you agree to be bound by these Terms. If you do not agree, do not use the app.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Pawpress on devices you own or control, for your own personal use, subject to these Terms and to the rules of the app store from which you obtained it (Apple App Store, Google Play, or other authorized distributor). All rights not expressly granted are reserved by Codeensis Ltd.
3. Pawpress is fiction, not veterinary advice
Each "issue" Pawpress prints is generated by an AI system from a single photo. The mood label (joyful, dramatic, cozy, mischievous, curious, zen, sleepy, melancholy, grumpy, longing), the pull-quote, and the short reading are fictional editorial copy written for entertainment in your pet's "voice". They do not reflect a clinical assessment of your pet's mental state, emotional state, behaviour, welfare, or health.
Pawpress does not diagnose conditions, identify pain or distress, recommend treatments, or replace observation by a qualified veterinarian. If your pet's behaviour or appearance worries you, please contact a veterinary professional — do not rely on a Pawpress reading.
To the maximum extent permitted by law, we disclaim any liability for harm to your pet (or to you) arising from your use of, or reliance on, Pawpress's output.
4. AI-generated content
Pawpress uses OpenAI Vision to generate each reading. AI systems can be wrong, biased, or absurd; they can read the same photo differently from one day to the next, and they can produce output that surprises you. By using Pawpress you accept that the content of any specific reading may not match what you would have said about the photo yourself. If a reading misses, you can pulp it.
You may not rely on a Pawpress reading as a statement of fact about your pet, about you, about anyone visible in the photo, or about anything else in the world. Pawpress readings are intended as light, magazine-style fiction.
5. Photos you submit
You confirm that you own (or have permission to use) each photo you submit to Pawpress, and that submitting it does not infringe any third party's rights or privacy. You retain full ownership of your photos. You grant us only the limited rights needed to deliver the service: to send the photo to OpenAI to generate a single reading, to store the photo and the reading in your private archive on our servers, and to render them back to you in the app. Our handling of photos is governed by the Privacy Policy.
6. Acceptable use
You agree not to:
- Submit photos containing identifiable people without their consent, or photos that are unlawful, defamatory, sexual, exploitative, or that depict abuse of an animal.
- Use Pawpress to harass, deceive, or impersonate anyone, including by sharing a generated reading as if it were a clinical or factual statement.
- Reverse-engineer, decompile, or disassemble the app, except to the extent allowed by mandatory law.
- Attempt to extract, replicate, or fine-tune any underlying model, prompt, or proprietary system that powers the reading.
- Bypass the daily issue quota, rate-limit, or authentication system; or use bots, scripts, or automated tools to drive issues at scale.
- Redistribute, resell, sublicense, or rent the app, the readings, or any of the app's other assets.
- Use the app to transmit malware, phishing content, or any code intended to disrupt third-party systems.
We may suspend or terminate access for any user who violates these rules.
7. Pricing and in-app purchases
Pawpress may be offered with a free tier, paid tiers, in-app purchases, subscriptions, or third-party advertising. Where any of these are available, they are sold and billed by Apple (App Store) or Google (Google Play) under the platform's standard terms. You can review or cancel a subscription, or request a refund, in your platform's account settings. We may change pricing, daily-issue quotas, or feature scope of any tier with reasonable notice; pricing changes do not apply to your current paid period.
8. Updates and availability
We may release updates, fixes, and new features to Pawpress from time to time. We may also discontinue features or the app itself at our discretion. The OpenAI model that powers the reading may be replaced or tuned without notice, which may change the style or quality of generated covers. Uptime, continued availability, and backward compatibility of any specific feature are not guaranteed.
9. Intellectual property
Pawpress, including its source code, design, name, logo, magazine layout, and editorial style, is the property of Codeensis Ltd. and is protected by copyright and other intellectual property laws. The app uses third-party services (OpenAI, Firebase) and open-source components subject to their respective licenses.
10. No warranty
Pawpress is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or that the app will be uninterrupted, error-free, or secure. Without limiting the foregoing, we make no warranty that any specific reading will be accurate, kind, on-tone, free of bias, free of factual error, or appropriate for any specific photo, person, or pet.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Codeensis Ltd., its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, business opportunity, harm to a pet, or any decision you make in reliance on Pawpress's output, arising out of or related to your use of (or inability to use) Pawpress, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or related to Pawpress shall not exceed the greater of (a) the amount you paid Codeensis for the app in the 12 months preceding the claim, or (b) ten euro (€10).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited (for example, liability for gross negligence, willful misconduct, death or personal injury caused by negligence, or as required under EU consumer protection law).
12. Indemnification
You agree to defend, indemnify, and hold harmless Codeensis Ltd. and its affiliates from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your use of Pawpress, (b) your reliance on Pawpress's output for any veterinary, medical, training, or factual purpose, (c) photos you submitted that you did not have the right to submit, (d) your violation of these Terms, or (e) your violation of any third party's rights or applicable law.
13. Privacy
Your use of Pawpress is also governed by our Privacy Policy, which describes what data Pawpress stores, what passes through OpenAI, what stays on your device, and your rights.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws rules. The courts of Limassol, Cyprus shall have non-exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
15. App store terms
If you obtained Pawpress through Apple's App Store or Google Play, you also agree to the terms of the respective platform. To the extent of any conflict between these Terms and platform terms, platform terms govern with respect to platform-specific obligations (for example, refunds, in-app purchases).
16. Apple App Store — additional terms
The following terms apply only when Pawpress is downloaded from the Apple App Store and supplement these Terms. They are required by Apple Inc. ("Apple"). In the event of any conflict between these Terms and Apple's Licensed Application End User License Agreement ("Apple EULA"), the Apple EULA controls solely with respect to use of Pawpress on Apple devices.
- Acknowledgement. These Terms are concluded between you and Codeensis Ltd. only, and not with Apple. Codeensis, not Apple, is solely responsible for Pawpress and its content.
- Scope of license. The license granted in section 2 is limited to a non-transferable license to use Pawpress on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Pawpress may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. Codeensis is solely responsible for providing any maintenance and support services for Pawpress. Apple has no obligation whatsoever to furnish maintenance or support services.
- Warranty. Codeensis is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Pawpress to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Pawpress to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Pawpress.
- Product claims. Codeensis, not Apple, is responsible for addressing any claims relating to Pawpress or your possession or use of it, including: (i) product liability claims; (ii) any claim that Pawpress fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property rights. In the event of any third-party claim that Pawpress or your possession and use of it infringes that third party's intellectual property rights, Codeensis, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints, or claims with respect to Pawpress should be directed to: Codeensis Ltd., Arch. Makariou III 155, 3026 Limassol, Cyprus, [email protected].
- Third-party beneficiary. You and Codeensis acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with respect to your license to use Pawpress on Apple devices, and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
17. Changes to these Terms
We may update these Terms as Pawpress evolves. Material changes will be reflected here with an updated "Effective" date above. Continuing to use Pawpress after a change means you accept the updated Terms.
